Spain too permissive about illegal tobacco trade

Gibraltar and Spain are in the middle of a blame game about where a stockpile of contraband tobacco originated. Now, the European Anti-Fraud Office (OLAF) blames Spain for having overly-permissive laws and for not making a strong effort to fight against it.

The accusation has merit, because in 2011 the government changed its law so that you had to be caught with at least 15,000 euros worth of cigarettes instead of 6,000 euros worth for the crime to be considered a criminal fraud case. That law still stands. This number is too high. At this point, Spain cannot point the finger at Gibraltar if it has not created a legal framework to discourage this kind of illegal trade.
