Autostrade emprende medidas legales contra regulador por caso Abertis

A principios de semana el primer ministro italiano afirmó en Madrid que no había problemas políticas para la fusión, lo que se interpretó como un visto bueno a la operación, mientras que ayer la Comisión Europea afirmó que el gobierno italiano ha infringido las leyes europeas al vetar la propuesta de fusión entre Abertis Infraestructuras SA y Autostrade SpA.

MILÁN (AFX-España) - Autostrade SpA ha presentado ante un tribunal administrativo de Roma una petición de que se anule la decisión emitida el 5 de agosto por el regulador italiano de autopistas, ANAS, de bloquear la fusión con Abertis Infraestructuras, valorada en unos 25.000 millones de euros.

El gobierno italiano ya anuló el techo del 5% en los derechos políticos de las constructoras que posean una participación en concesionarias de autopistas. Esto bloqueaba la fusión de Autostrada con Abertis, porque ACS tiene el 24,9% de Abertis.

Autostrade starts legal action against regulator opposition to Abertis merger

Autostrade SpA said it has filed a request with a Rome-based administrative court to annul a decision issued on Aug 5 by the motorway regulator ANAS to block the company's planned 25 bln eur merger with its Spanish peer Abertis Infraestructuras SA.

Earlier this week, prime minister Romano Prodi said the merger could proceed, while the European Commission said the Italian government has broken EU law in blocking the deal.
