The case for respecting independent-minding judges

One day before the Provincial Court of Madrid issues its decision about the public prosector's petition of judge José Elpidio Silva's ruling, which sent former Caja Madrid president Miguel Blesa to prison, Silva has accepted all media questions and made the most of a talk on preventing money laundering and other white-collar crime on elEconomista's Luris&Lex forum.

Silva rarely takes such liberties. Since the Blesa case investigations began, he has kept to the background, saying that he has had to bear all sorts of pressure and meddling, some of which he cannot speak about.

Silva's statement shows how the Spanish legal system is often not allowed to operate independtly, especially when its cases are entangled with high politics and the unwanted consequences.

It is important to give a judge the proper independence and power to do his job. It is important to remember that people are innocent until proven guilty, there are obvious indications that Miguel Blesa committed several crimes. The public prosecutor, which has not done its job very well, is compromising the security of justice in the Spanish legal system.
