Mirus Biosciences Suit against Fugent Dismissed



    On September 14, 2011, Mirus Biosciences, LLC sued Fugent, LLC for patent infringement, and approximately 3 months later, on December 23, 2011, the attorneys for Mirus Biosciences, LLC filed a dismissal of the suit with prejudice according to attorneys from Haus, Roman and Banks, LLP. Mirus Bio, LLC vs. Fugent, LLC, Case No. 11-CV-630-slc, U.S. District Court, Western District of Wisconsin.

    In the suit, Mirus alleged infringement based, in part, on the making and sale of Fugene®6. Fugent is the exclusive manufacturer of Fugene®6 and Fugene®HD. Fugent is now free to continue commercializing Fugene®6 and Fugene®HD for use by its customers, without further legal challenge by Mirus. The litigation was resolved to Fugent´s satisfaction and with no monetary compensation or other damages being paid by Fugent to Mirus.

    Fugene® products are widely used, and currently referenced in thousand of publications, over 1300 issued US patents and almost 3700 published US patent applications.

    Fugene®6 and Fugene®HD products are distributed by Promega Corporation.
