Gas Natural says more info on possible Endesa, E.ON collusion now vs CNMV probe

Gas Natural SDG SA feels that a further probe of possible collusion between Endesa SA and E.ON AG and also Deutsche Bank is warranted as much more information has become available since the first probe by stock market regulator CNMV, CEO Rafael Villaseca said.

Speaking at a webcast following Gas Natural's nine months results, Villaseca said: 'There is much more information now than when the CNMV carried out its investigation in March.'

The CEO said Gas Natural said it has started proceedings against Endesa, E.ON and Deutsche Bank because it has 'more than reasonable doubts,' that communication between E.ON, Endesa and Deutsche Bank ahead of E.ON's bid for Endesa was free of confidential information.

In March, the CNMV declared that it had not found evidence of exchanges of confidential information between the three companies after initial investigations.

Yesterday, E.ON CEO Wulf Bernotat said that he doubts that the collusion case currently going through the courts in Barcelona at the petition of Gas Natural will bring any further developments.

Gas Natural's cash and share bid for Endesa, worth just over 20 eur per share, is currently blocked by court injunctions at Endesa's request, while E.ON's 35 eur per share bid is expected to win CNMV approval next week.

Villaseca said it reserves any decision on how it will proceed in relation to its bid for Endesa until after the injunctions blocking it are lifted.

'At the moment our bid is blocked, there is little we can do, we can do nothing,' he noted.

that there might have been privalaged information in this case, we are waiting for the outcome of the case

si quitan cautelares, y levante, si gas natural decidiera proseguir.
